These Terms & Conditions (“Terms”) govern all purchases made on the website https://www.rizdraws.com and any related pages (the “Site”).
By placing an order on the Site, you agree to be bound by these Terms.


1. Seller Information

The shop is operated as an independent artist brand based in Spain.


2. Scope & Applicable Law

These Terms apply to all orders placed through the Site, whether the customer is located in Spain, within the European Union (“EU”) or in a third country.

All contracts are governed by Spanish law, in particular Spanish consumer and e-commerce regulations, as well as applicable EU consumer protection law.
If you are a consumer residing in the EU, the mandatory consumer rights of your country of residence will still apply and cannot be waived by these Terms.


3. Customers & Language

  • The Site is intended for individual consumers and small orders, not for wholesale unless explicitly agreed.
  • You must be at least 18 years old or use the Site under the supervision of a parent or legal guardian.
  • The main language of these Terms and of the contract is English.

4. Products, Colours & Availability

  • We do our best to describe products accurately and to show colours as faithfully as possible. However, colours may vary slightly due to screen settings and printing limitations.
  • Many items are limited run, may sell out quickly and may not be restocked.
  • We reserve the right to change, limit or discontinue products at any time without prior notice.

If a product is unavailable after you place an order, we will contact you and offer an alternative, a new production timeline (if possible) or a refund.


5. Prices, Currency & Taxes

  • All prices are shown in EUR (€) unless stated otherwise.
  • Prices include or exclude VAT depending on your location and VAT rules applicable at checkout.
  • Shipping costs are calculated and displayed before you confirm the order.

We may change prices at any time, but such changes will not affect orders that have already been placed and confirmed.


6. Ordering Process & Contract Formation

  1. You add the desired products to your cart.
  2. At checkout, you provide your billing and shipping details and choose a payment method.
  3. Before confirming, you can review and correct your order.
  4. By clicking “Place Order” (or similar button), you submit a binding order.
  5. You then receive an order confirmation email. This is an acknowledgement that we have received your order; the contract is considered formed when we accept the order and start processing or when payment is successfully captured.

We reserve the right to refuse or cancel an order in cases such as suspected fraud, incorrect prices or lack of stock. In those cases, any payment already made will be refunded.


7. Payment Methods

Available payment methods are shown at checkout (for example, bank card, PayPal or other providers).

  • Payment is usually charged immediately when you place the order.
  • Third-party payment providers have their own terms and privacy policies, which will also apply to your use of their services.

8. Shipping, Delivery & DDP

Shipping conditions are described in more detail on our Shipping & Delivery Information page, which forms part of these Terms.

Key points:

  • Processing time is usually 3–7 business days before dispatch.
  • Delivery times depend on the destination, and are estimates only.

Customs, duties & DDP

  • Shipments within the EU are not subject to customs duties; VAT is handled according to EU rules.
  • For most non-EU countries, we use a Delivered Duty Paid (DDP) shipping method whenever available. This means that import VAT, customs duties and standard customs handling fees are covered by us and included in the total amount you pay at checkout.
  • Under normal circumstances, you should not be charged extra customs duties upon delivery. If your local postal operator unexpectedly claims additional fees, please contact us so we can review the case together.

9. Right of Withdrawal & Returns (EU Consumers)

This section applies to customers who are consumers residing in the EU and ordering as private individuals.

9.1 Legal right of withdrawal (cooling-off period)

Under EU and Spanish law, you generally have the right to withdraw from an online purchase within 14 calendar days without giving any reason, starting from the day you (or a person designated by you) receive the goods.

To exercise this right, you must inform us clearly (for example, by email to [email protected]) within the 14-day period that you wish to withdraw from the contract. You can use a standard withdrawal form if you wish, but it is not mandatory.

After notifying us:

  • You must return the goods to us within 14 calendar days from the date on which you communicated your decision to withdraw.
  • You must take reasonable care of the goods while they are in your possession.

9.2 Exceptions to the right of withdrawal

The legal right of withdrawal does not apply in certain cases, for example:

  • Custom-made or personalised products made to your specifications or clearly personalised (e.g. items with your name, custom colours or custom commissions).
  • Digital content supplied in a non-tangible form (such as digital files or downloads) once download or access has started with your prior express consent and acknowledgement that you lose the right of withdrawal.
  • Other exceptions provided by applicable EU and Spanish law.

These exceptions will be indicated as clearly as possible on the product page. For such items, orders are generally final except in cases of damage or error on our side.

9.3 Costs of returns (EU)

If you exercise your legal right of withdrawal:

  • You are responsible for the direct cost of returning the goods to us, unless we have expressly agreed otherwise.
  • We recommend using a tracked shipping method, as you are responsible for the goods until they reach us.

If the product is defective or we sent you the wrong item, please contact us first; in those cases, different conditions may apply (see section 10 below).

9.4 Refunds (EU withdrawal)

When you validly withdraw from the contract:

  • We will refund the amount you paid for the goods, including the standard initial shipping cost (if applicable), within 14 days from the date we are informed of your decision to withdraw.
  • We may withhold the refund until we have received the returned goods or you have provided proof of having sent them back, whichever is earlier.
  • If the goods have been handled beyond what is necessary to establish their nature, characteristics and functioning, we may deduct an amount corresponding to the diminished value.

10. Returns & Replacements – Our Commercial Policy

In addition to the mandatory legal rights described above, the following rules apply to our commercial return and replacement policy:

10.1 Where we accept physical returns

  • We only accept physical returns from countries that are members of the European Union (EU), except where otherwise required by law.
  • For customers outside the EU, due to customs and high shipping costs, we generally do not accept returns, except in the case of damaged or incorrect items (see 10.2).

10.2 Damaged or incorrect items (all countries)

If your order arrives damaged or you receive an incorrect item:

  1. Please contact us at [email protected] as soon as possible, ideally within 7 days of delivery.
  2. Include your order number and clear photos of the packaging and the item.
  3. After review, if the damage or error is confirmed, we will offer one of the following solutions:
    • Replacement of the item (where stock is available); or
    • Another appropriate solution if replacement is not possible (for example, a refund or partial refund).

When the problem is clearly on our side (production defect, wrong product sent, etc.), we will cover the costs of reshipping a replacement.

10.3 Change of mind & final sales

  • Outside the mandatory right of withdrawal for EU consumers and the specific damaged/incorrect cases described above, orders are considered final.
  • We do not offer returns or exchanges for change of mind, wrong size or not reading the description, especially for customers outside the EU or for customised / limited items.

Nothing in this section limits your statutory rights as a consumer under applicable law.


11. Digital Products (if applicable)

If the shop offers digital products (e.g. digital art files, printables):

  • By purchasing and downloading digital content, you expressly agree that we begin delivery immediately and you acknowledge that you lose your legal right of withdrawal once the download or access has started, as permitted by EU law.
  • If you have problems accessing the files, please contact us and we will help you resolve the issue.

12. Intellectual Property

All artworks, designs, images, texts, logos and other content on the Site are the intellectual property of Diego Fonteriz Alvarez / Rizdraws, unless otherwise stated.

  • You may not reproduce, distribute, modify, or use our content for commercial purposes without our prior written permission.
  • Purchasing a product does not grant you any licence to reproduce or resell the designs, except for normal personal use of the physical product.

13. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential losses, such as loss of profits, loss of business, or loss of data.
  • Our total liability for any claim related to an order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for fraudulent misrepresentation, and nothing affects your statutory consumer rights.


14. Privacy & Cookies

Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms and is available on the Site.
We also use cookies and similar technologies as described in our Privacy Policy (and any separate Cookies section if applicable).


15. Changes to These Terms

We may update or modify these Terms from time to time, for example to reflect changes in the law or in our business.

  • The version applicable to your order is the one in force at the time you place the order.
  • The “Last updated” date at the top of this page indicates when the Terms were last revised.

16. Governing Law & Disputes

These Terms and any disputes or claims arising out of or in connection with them are governed by Spanish law, without prejudice to the mandatory consumer protection rules of your country of residence if you are an EU consumer.

You may also have access to EU online dispute resolution platforms or local consumer authorities, depending on your country of residence.
